About these terms

These terms govern the use of the esgreen.com.br website and the campaign pages at materiais.esgreen.com.br (the “site”), maintained by ESGreen Avaliação e Monitoramento ESG Ltda., registered under CNPJ (Brazilian company registration number) no. 48.184.229/0001-50, headquartered at Av. Presidente Juscelino Kubitschek, 1327, 4th and 8th floors, Vila Nova Conceição, São Paulo/SP, CEP 04543-011 (“ESGreen”).

By using the site, you agree to these terms. If you do not agree, do not use the site.

The ESGreen Platform (painel.esgreen.com.br and API) is not governed by these terms. Use of the platform is governed by the contract and the specific terms entered into with each client.

Informational content

The site content, including product pages, ESGreen Research, news, regulatory analyses, examples and demos, is for informational purposes.

  • The ESGreen Score, the IRC-ESGreen and the indices published by ESGreen are assessments based on public and regulatory data and on proprietary models. They do not constitute a credit rating, an investment recommendation or a legal opinion, and must be used as an input for decisions made by those who use them, under their own responsibility.
  • Content about rules and regulation does not constitute a legal opinion. Always confirm the official text of the rule and consult your legal counsel.
  • Charts, maps and demos labeled “Illustrative data” use fictitious data and do not represent real clients, portfolios or operations.
  • Corporate figures show their reference date. They may change after that date.

Permitted use

You may browse, read and share links to the site for personal or professional use. By using the site, you agree not to:

  • use the site for illegal, fraudulent or defamatory purposes, or in ways that violate the rights of third parties;
  • attempt to access restricted areas, such as the administrative area, without authorization;
  • disable, circumvent or interfere with security features, such as the forms' anti-bot verification;
  • collect site content in an automated, bulk manner without prior written authorization;
  • send malicious code, overload the site or impair its operation;
  • present ESGreen content as your own or alter that content in a way that changes its meaning.

Intellectual property

The ESGreen, ESGreen Score and IRC-ESGreen trademarks, as well as the logos, texts, analyses, charts, published methodologies and site code, belong to ESGreen or its licensors and are protected by intellectual property law.

Trademarks and logos of clients, partners and programs displayed on the site belong to their respective owners and appear with authorization or to identify the relationship described.

Quoting content

You may quote excerpts from ESGreen Research content and site pages in studies, news reports and other works, provided that:

  • you credit ESGreen as the source and include a link to the original page;
  • you keep the reference date of any figures quoted;
  • you do not change the meaning of the quoted excerpt.

To reproduce content in full or use it in commercial material, request authorization through the contact form.

Forms and information you submit

  • Provide true and up-to-date information in the forms. You are responsible for the information you submit.
  • By requesting a CNPJ pre-assessment, you declare that you have a legitimate reason for the lookup, such as assessing a current or future business relationship with the company (client, supplier or business partner).
  • Do not submit sensitive personal data through the contact forms, or third-party data that is not necessary for your request. In the Whistleblower channel, provide sensitive or third-party data only when it is essential to describe the facts being reported.
  • We use what you submit to respond to your request and for the other purposes described in the Privacy Policy.
  • The whistleblower channel must be used in good faith to report conduct contrary to ethics, the law or ESGreen's policies. Commercial requests must be made through the contact form.

Third-party links and content

The site contains links to third-party sites, such as media outlets, social networks and government bodies, and displays YouTube videos. ESGreen does not control these sites and is not responsible for their content, availability or privacy practices.

The link to the ESGreen Platform leads to a service governed by the contract and the specific terms entered into with each client.

Availability

We work to keep the site available and secure, but it may go offline for maintenance, due to third-party failures or for reasons beyond our control. We may change, suspend or remove pages and content at any time.

Liability

To the extent permitted by law, ESGreen is not liable for:

  • decisions made solely on the basis of the site's informational content;
  • damages caused by use of the site in breach of these terms;
  • unavailability, failures or delays caused by third parties, such as internet and cloud providers;
  • content of third-party sites accessed through links on the site.

Nothing in these terms limits any rights that the law grants you and that cannot be excluded by contract.

Privacy and cookies

The processing of personal data on the site is governed by the Privacy Policy and the Cookie Policy.

Changes to these terms

We may update these terms. The version and update date appear at the top of this page. Using the site after a new version is published means you accept that version.

Governing law and jurisdiction

These terms are governed by the laws of the Federative Republic of Brazil. The courts of the Judicial District (Comarca) of Florianópolis, Santa Catarina, are designated as the venue for resolving matters related to these terms, except where the law guarantees you a different venue, such as the courts of your domicile in consumer relationships.
